  • File the following forms with the state of North Dakota: 1099-B, 1099-DIV, 1099-INT, 1099- MISC, 1099-PATR, 1099-R and 1099-S.
  • Filing due dates: File the state copy of form 1099 with the North Dakota taxation agency by March 31, 2021.
  • Reporting threshold: If you file 250 or more 1099 forms with North Dakota you must file electronically.
  • When filing federal copies of forms 1099 with the IRS from the state of North Dakota the mailing address is: Department of the Treasury , Internal Revenue Service Center , Kansas City, MO 64999.
  • When filing state copies of forms 1099 with North Dakota department of revenue, the agency contact information is: State Tax Commissioner, State Capitol, 600 E. Boulevard Avenue, Bismarck, N.D. 58505.
  • Compliance rules: A requirement to file a North Dakota information return for a payment other than wages is satisfied by filing a copy of the federal 1099 form that is filed with the Internal Revenue Service. Forms 1099 must be filed electronically with ND if there is a requirement to file electronically for federal purposes and the quantity of 1099 forms required to be filed is 250 or more. For electronic media submission, 1099 data needs to be formatted according to the specifications contained in IRS Publication 1220 and sent using a CD or USB Flash Drive. Although ND participates in the Combined Federal/State Program, this option may not be used to report any payment from which North Dakota income tax is withheld.

Important Note (for both paper and electronic filers): There is a new form called 1099-NEC that is used to report None-employee compensation (instead of Box 7 on form 1099-MISC). The IRS does not forward 1099-NEC forms to the state, you need to file directly with the North Dakota DOR.
